Per aprire un B&B, quindi, occorre consultare le leggi regionali di settore o i regolamenti comunali specifici. Ciascuna Regione ha dato infatti attuazione al disposto nazionale, fornendo una disciplina specifica.
Dopo aver consultato la legge regionale che regola questo tipo di struttura, è necessario recarsi presso lo Sportello Unico delle Attività Produttive(SUAP) del comune di appartenenza.
Attraverso lo sportello o tramite Internet si potrà ritirare la modulistica necessaria per presentare la Segnalazione certificata di inizio attività (SCIA)
L’enorme vantaggio offerto da questo nuovo strumento è dato dall’immediatezza con cui si determina l’apertura dell’attività, senza attendere i 30 giorni previsti in precedenza. L’Amministrazione Pubblica dovrà accertare, entro 60 giorni dal ricevimento, il possesso e la veridicità dei requisiti dichiarati ed eventualmente adottare i dovuti provvedimenti per vietare la prosecuzione dell’attività e/o sanzionare colui che ha sottoscritto la mendace dichiarazione.
Alla SCIA devono essere allegati i documenti necessari per il completamento della pratica (esempio: planimetria dell’abitazione, contratto di proprietà o di affitto, polizza assicurazione responsabilità civile a favore dei clienti, ecc.). Tali allegati variano da Regione a Regione.
L’ultimo passo procedurale riguarda l’avvio delle pratiche, gestite dalle A.A.P.I.T. (Azienda autonoma di cura, soggiorno e turismo) o dagli Uffici Turistici locali, per la classificazione della struttura e la comunicazione degli ospiti alle Autorità di Pubblica Sicurezza).

L’attività di Bed and Breakfast è facile da gestire, poco rischiosa ed è molto adatta a una gestione familiare. Ma attenzione, ci sono dei requisiti da rispettare!
Nello specifico, l’attività di B&B in Calabria inizialmente era regolata dalla Legge regionale 26 febbraio 2003 che successivamente ha visto la sua abrogazione nel 07/08/2018.
Attualmente la legislazione che regola tale attività è la Legge regionale 7 agosto 2018, n. 34.
