Se una banca fallisce cosa succede ai risparmi di chi ha un conto nella banca fallita?
Ne abbiamo sentito parlare soprattutto ultimamente: il fallimento della banca e la conseguente perdita del patrimonio del singolo correntista. Vediamo da vicino cosa succede nel caso in cui si verifica il temuto bail-in.
CHE COS’E’ IL BAIL IN?
Bail In è un’espressione inglese, la cui traduzione è “cauzione interna”, con la quale ci si riferisce a un meccanismo voluto dall’Unione europea, ovvero un sistema di risoluzione di un’eventuale crisi bancaria e fallimento banche che prevede il coinvolgimento diretto di azionisti, obbligazionisti e correntisti della banca stessa.
Con la direttiva europea sulla risoluzione delle crisi bancarie, in vigore dal gennaio 2016, nel caso in cui una banca sia in difficoltà non interverrà più lo Stato, ma dovranno farsi carico delle perdite anche i privati: azionisti, obbligazionisti delle subordinate, obbligazionisti senior e correntisti con depositi superiori a 100mila euro.
Se tutto questo non fosse ancora sufficiente a coprire le perdite interverrà un fondo finanziato dalle banche. Mentre, i depositi fino a 100mila euro per depositante, continuano a essere tutelati dal Fondo Interbancario di Tutela dei Depositi.
FALLIMENTO DELLA BANCA E RIPERCUSSIONI
Cosa succederebbe a questo patrimonio in caso di fallimento della banca e di attivazione del bail-in?
Ecco, di seguito, una panoramica degli scenari che si aprirebbero
Conto corrente
A rimborsarli ci pensa infatti un apposito organismo di garanzia: il Fonto Interbancario di Tutela dei Depositanti (Fitd), che protegge le giacenze sino a un massimo di 100 mila euro per ogni correntista. Meglio dunque non tenere in deposito una cifra superiore a 100 mila euro.

Obbligazioni della banca
Le note dolenti per la famiglia risparmiatrice iniziano con i soldi investiti in obbligazioni. Se i bond sono stati emessi dalla stessa banca fallita, infatti, c’è il rischio concreto di perdere tutto quanto investito, soprattutto se si tratta di bond subordinati. Sono titoli che, in caso di crack della banca, possono essere rimborsati soltanto quando risultino prima soddisfatti tutti gli altri creditori (esclusi gli azionisti che vengono invece dopo). Il rischio di perdere tutto il patrimonio c’è anche per chi ha investito in obbligazioni bancarie ordinarie (senior) mentre fortunatamente non c’è per le obbligazioni garantite (covered bond).
Obbligazioni di altre società
Vanno molto meglio le cose per le somme investite nella obbligazioni emesse da altre società diverse dalla banca fallita. Questi bond, infatti, sono custoditi dall’istituto di credito in un deposito titoli ma restano di esclusiva proprietà del risparmiatore, anche in caso di dissesto della banca. Nessun rischio, dunque, in caso di bail-in.
Fondi di investimento
In salvo sono anche i soldi destinati dal risparmiatore ai fondi comuni di investimento, compresi quelli venduti e gestiti dal gruppo bancario fallito. Il patrimonio del fondo (con i titoli che lo compongono) è infatti custodito presso un’altra banca depositaria ed è rigidamente separato da quello della società che lo amministra
Polizze assicurative
C’è da dormire sonni abbastanza tranquilli anche per le somme investite in qualche polizza assicurativa, persino quando a emetterla è stata una compagnia che fa parte dello gruppo bancario fallito. Il patrimonio dell’impresa assicuratrice e i fondi collegati alle polizze sono infatti rigidamente separati da quello della controllante
Azioni
Le regole sul bail-in stabiliscono infatti che, in caso di fallimento di un istituto di credito, gli azionisti sono i soggetti più colpiti e possono essere indennizzati soltanto quando risultino soddisfatti tutti gli altri creditori. Discorso diverso, invece, se le azioni possedute sono di altre società quotate in borsa. Anche in questo caso, come per i bond societari e i Buoni del Tesoro, i titoli sono a di esclusiva proprietà del cliente e restano tali anche dopo un eventuale crack della banca che li custodisce.
CONSIGLI PRATICI
Prima di scegliere l’istituto bancario a cui affidare i tuoi risparmi, è sempre bene assicurarsi della solidità della banca, ancor più dopo l’emendamento del gennaio 2016.
Puoi farlo controllando il Cet1 ratio che è il coefficiente indicante il rapporto tra il patrimonio di base di una banca e gli impieghi ponderati per il rischio, lo trovi pubblicato online nel bilancio della banca stessa.

Срок оплаты штрафа со скидкой
Скидка на штрафы ГИБДД действует в
течение 20 дней с момента вынесения постановления.
Максимум можно оплатить до полуночи 20-го дня,
после чего придется гасить долг полностью.
Если уведомление задержалось, потерялось на
почте, ушло не на тот адрес либо водитель получил письмо позже,
так как был в командировке, отпуске или
больнице, можно восстановить истекший срок оплаты штрафа со скидкой.
Для этого нужно составить ходатайство в произвольной форме и направить в ГИБДД, из которого пришло постановление.
В заявлении необходимо привести доводы, по
которым хотите восстановить срок уплаты штрафа ГИБДД со скидкой 50%.
В качестве доказательств приложите подтверждающие документы: справку из больницы, билеты,
выписку из почтового реестра и т.
п.
Если причина уважительная и документы это подтвердят, срок оплаты штрафа ГИБДД со скидкой 50% восстановят.
Если доводы и подтверждающие документы неубедительны, в восстановлении откажут.
